Terms of Sale

These Terms of Sale apply when you buy physical goods from TheProGinge through our website. Please read them before placing an order.

1. About us

Business address:

TheProGinge

United Kingdom

2. Products

We aim to describe and display our products accurately. Colours, scale and appearance can vary slightly between screens, photographs and the physical product.

Garment dyed, printed and made to order products may also have small variations that are normal for the manufacturing process.

Product descriptions, materials, sizing information, care instructions and any edition limits shown on the product page form part of the information provided to you before purchase.

3. Orders and when a contract is formed

When you place an order, you are offering to buy the product at the price shown.

We will send an order acknowledgement after checkout. A binding contract is formed when we accept your order and confirm it by email, or when we begin fulfilment, whichever happens first.

We may decline or cancel an order before acceptance if, for example:

• a product is unavailable

• there is an obvious pricing or description error

• payment cannot be authorised

• we reasonably suspect fraud or misuse

If we cancel an order after taking payment, we will refund the amount paid.

4. Prices and payment

Prices are shown in the currency displayed at checkout.

The total price, including any applicable taxes and delivery charges that we collect, will be shown before you place your order.

Payment must be made using one of the payment methods offered at checkout.

We do not receive or store your full card details. Payment information is handled by the payment service provider used at checkout.

5. Delivery

Delivery options, prices and estimated times are shown at checkout or on the relevant product page.

Some products are produced after you order, so fulfilment time may be separate from carrier delivery time.

Unless a different delivery period has been agreed with you, we will deliver goods without undue delay and normally within 30 days of the contract being made.

Delivery estimates are not guaranteed dates unless we expressly agree otherwise.

You are responsible for giving us a complete and accurate delivery address. If an order is returned or delayed because the address supplied was incomplete or incorrect, we may ask you to pay any reasonable additional delivery cost before resending it.

6. Your right to change your mind

For most physical goods bought online, UK consumers have a legal right to cancel without giving a reason.

You must tell us that you wish to cancel within 14 days after the day you receive the goods. If an order contains goods delivered on different days, the cancellation period runs from the day after the final item is delivered.

After telling us that you wish to cancel, you normally have a further 14 days to send the goods back.

Please see our Returns & Refunds Policy for the return process, refund timing and any return postage costs.

You may examine and try a product in the same way you reasonably could in a shop. We may reduce a refund to reflect any loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Some products are produced only after an order is placed. Production on demand by itself does not remove your statutory cancellation rights.

A cancellation exception may apply only where a product is genuinely made to your personal specification or clearly personalised for you, and we will make that clear before you buy.

7. Faulty, damaged or incorrect goods

Nothing in these terms limits your statutory rights.

Goods must be of satisfactory quality, fit for purpose and as described.

If an item is faulty, damaged, not as described or otherwise fails to meet your legal rights, contact us at hello@theproginge.com with your order number and, where useful, photographs of the issue.

UK consumers normally have a 30 day short term right to reject faulty goods for a refund. Other rights, including repair or replacement and later remedies, may also apply.

We will cover reasonable return costs where the goods are faulty, damaged or incorrect and the law requires us to do so.

8. Limited editions and availability

Some TheProGinge products may be released in limited quantities or numbered editions.

A stated edition size refers to the maximum number we intend to sell in that edition.

Returns, cancellations, production errors or replacement stock can affect which individual edition numbers are ultimately supplied.

We do not guarantee that a different size or replacement unit from a limited edition will be available.

Your statutory refund and remedy rights are not affected by the limited nature of a product.

9. Intellectual property

The TheProGinge name, branding, original graphics, photographs, written content and other material owned by us may not be reproduced, sold or used commercially without permission.

Some artwork or product imagery may also contain material licensed from artists or other rights holders.

All third party rights remain with their respective owners.

10. Our responsibility to you

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

We supply products for personal consumer use unless we agree otherwise.

To the extent permitted by law, we are not responsible for business losses such as loss of profit, revenue, opportunity or business interruption arising from a consumer purchase.

11. Events outside our reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control.

If this affects your order, we will contact you where practical and take reasonable steps to minimise the effect.

Your legal rights regarding delayed delivery remain unaffected.

12. Personal information

We use personal information in accordance with our Privacy Policy and Cookie Policy.

13. Complaints

If something has gone wrong, please contact us first at hello@theproginge.com.

We will try to resolve the issue fairly and as quickly as reasonably possible.

14. Governing law

These Terms of Sale are governed by the laws of England and Wales.

If you are a consumer living elsewhere, this does not take away any mandatory consumer protections that apply to you under the law of your place of residence.

You may bring proceedings in any court that has jurisdiction under applicable law.

15. Changes to these terms

We may update these terms from time to time.

The terms that apply to your order are the version made available to you when you placed that order.
